Alienation of affection is a term used to describe infidelity. In North Carolina, there are three criteria that need to be met for an affair to qualify as alienation of affection:
1. The marriage was happy and loving before the affair
2. The marriage is no longer happy
3. This decline in happiness is caused directly, or in part, by the affair.
